9. Termination and Account Closure

9.3 Inactive Accounts

10. Dispute Resolution and Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the jurisdiction in which 8k818 is licensed to operate. Any disputes arising from or related to these Terms shall be subject to the exclusive jurisdiction of the courts of that jurisdiction.

10.3 Arbitration

If a dispute cannot be resolved through the internal complaint process, both parties agree to submit the dispute to binding arbitration in accordance with the rules of a recognized arbitration body. The decision of the arbitrator shall be final and binding on both parties.

11. Limitation of Liability

To the fullest extent permitted by law, 8k818, its parent company, affiliates, directors, officers, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of (or inability to access or use) the 8k818 platform;
• Any conduct or content of any third party on the platform;
• Any unauthorized access, use, or alteration of your transmissions or content;
• Technical failures, including server downtime, connectivity issues, or software bugs;
• Errors or inaccuracies in game outcomes or results;
• Actions taken by payment processors or third-party service providers.

In no event shall 8k818's total liability to you for all claims exceed the amount you have deposited into your account in the six (6) months preceding the claim.

12. Amendments to Terms

8k818 reserves the right to amend, modify, or update these Terms and Conditions at any time, with or without prior notice. Amendments will become effective immediately upon posting on the Website. Your continued use of the 8k818 platform following the posting of revised Terms constitutes your acceptance of such changes.

It is your responsibility to review these Terms periodically to stay informed of any updates. If you do not agree with any amendment, your sole remedy is to discontinue use of the 8k818 platform and close your account.
